Section 136(1)(a) – Highway Traffic Act (HTA)
A conviction for running a stop sign:
When a driver goes through a stop sign without stopping, they have committed an offence under the Highway Traffic Act. There are two common defenses for fighting a ticket for failing to stop at a stop sign or a marked stop line.
Under this section, a driver has a duty to yield the right of way at the intersection that they are approaching, and to stop for 3-5 seconds.
Penalties for Disobeying Stop Sign
The fine attached to a stop sign ticket is not the only penalty. A stop sign ticket has four penalties total:
- three (3) demerit points
- fine of one hundred and ten dollars ($110.00)
- conviction registered on your driving record for three years
- insurance increases and determination of fault in accident cases
